FurFun Terms and Conditions

These terms and conditions apply to all orders, agreements, and services offered by FurFun, located at Jimmy Brownstraat 20, 1336 KD Almere, The Netherlands. By using our website or services, you agree to these terms and conditions.

1. Definitions

The following terms are defined as follows in these terms and conditions:

  • FurFun: The provider of products and services, based in the Netherlands.
  • Customer: The natural or legal person entering into an agreement with FurFun.
  • Agreement: Any arrangement or contract between FurFun and the customer.
  • Products: All goods offered by FurFun via the website.
  • Website: FurFun’s website, accessible at www.furfun.nl.

2. Applicability

  • These terms and conditions apply to all offers, quotations, agreements, and deliveries from FurFun unless otherwise agreed in writing.
  • By placing an order, you accept these terms and conditions.
  • Deviations from these terms are only valid if agreed upon in writing.

3. Offers and Agreements

  • FurFun’s offers are non-binding. FurFun reserves the right to change or withdraw any offer.
  • An agreement is established when the customer places an order and FurFun confirms it.
  • Obvious errors or mistakes in the offer do not bind FurFun.

4. Prices and Payments

  • All prices on the website include VAT but exclude shipping costs unless otherwise stated.
  • Shipping costs are clearly specified during the ordering process.
  • Payments must be made using the payment methods offered on the website.

5. Delivery and Execution

  • FurFun strives to deliver orders within the indicated delivery time.
  • Delivery times are indicative and not strict deadlines.
  • If a product is out of stock, the customer will be informed as soon as possible and has the right to cancel the agreement at no cost.

6. Right of Withdrawal

  • Customers have the right to withdraw from the agreement within 30 days of receiving the product without providing a reason.
  • During the withdrawal period, the customer must handle the product and packaging with care.
  • To exercise the right of withdrawal, the customer must contact FurFun at info@furfun.nl.

Exceptions to the right of withdrawal include:

  • Products that are custom-made or personalized.
  • Products that cannot be returned for hygiene reasons if the seal has been broken.
  • Products that are no longer in their original packaging, have missing labels, or are dirty/damaged.

7. Returns and Refunds

  • Returns are accepted within 30 days of receiving the product, provided the product is undamaged and in its original packaging.
  • Return costs are the responsibility of the customer unless otherwise agreed.
  • Once the returned product has been received and inspected, FurFun will process the refund within 10 business days using the original payment method.

8. Warranty and Conformity

  • FurFun guarantees that its products comply with the agreement, the specifications listed in the offer, and reasonable standards of reliability and usability.
  • If a delivered product is defective, the customer must notify FurFun within 14 days of discovering the defect.

9. Liability

  • FurFun is not liable for any indirect damage, including consequential damages, loss of profit, or business interruption.
  • FurFun’s total liability towards the customer is limited to the amount paid by the customer for the product or service.

10. Complaints Procedure

  • Complaints about the execution of the agreement must be submitted to info@furfun.nl within a reasonable time, fully and clearly described.
  • FurFun will respond within 14 days of receiving the complaint. If more time is needed, the customer will be notified within this timeframe.
  • If a complaint cannot be resolved by mutual agreement, the customer has the right to submit the dispute to a competent dispute resolution committee.

11. Force Majeure

  • FurFun is not obliged to fulfill any obligation if hindered by force majeure.
  • Force majeure includes, but is not limited to, natural disasters, wars, strikes, pandemics, and disruptions in internet or transport services.

12. Intellectual Property

  • All intellectual property rights related to the products, services, and content on the website remain the property of FurFun.
  • It is prohibited to copy, distribute, or use any part of the website or products for commercial purposes without prior written permission from FurFun.

13. Governing Law and Disputes

  • All agreements and disputes are exclusively governed by Dutch law.
  • Disputes will be submitted exclusively to the competent court in the Netherlands.

14. Changes to Terms and Conditions

  • FurFun reserves the right to amend these terms and conditions. The most recent version will always be available on our website. Customers will be informed of significant changes in a timely manner.
